Privacy Policy

Welcome to Plates. Protecting your privacy is extremely important to us. Accordingly, we’re providing this Privacy Policy to explain our practices regarding collecting, using, and disclosing information we receive when you use our Services. This Privacy Policy applies to the Plates, LLC (“Plates”, “we”, “us”, “our”) proprietary dining service mobile application (the “App”) and the products and services we offer you (“End-User”, “you”, “your”), via the App (the “Services”). This Privacy Policy does not apply to any third-party websites, services, or applications, even if they are accessible through our Services. Any information we collect is subject to the privacy policy in effect at the time that Information is collected. We may, however, modify and revise this Privacy Policy from time to time. If we make any material changes to this Privacy Policy, we’ll notify you of those changes by posting them on the Services or by sending you an email or other notification, and we’ll indicate when those changes will become effective. Finally, please note that unless we define a term in this Privacy Policy, all capitalized words used in this Privacy Policy have the same meanings as in our Terms of Service.

Information We Collect and How We Use It

We may collect the following types of information:

Information you provide: When you sign up for a Plates account (“End-User account”), we ask you for personal information. We may combine the information you submit under your account with information from other Plates services or third parties to provide a better experience and improve our services' quality.

Cookies: When you access the App, we may send one or more cookies to your computer or mobile device.

Log information: Our servers automatically record certain information when you access our App and/or utilize the Services. These logs may include information such as your request, your interaction with a service, your Internet Protocol address, the date and time of your request, and one or more cookies that may uniquely identify your account.

 

User communications: When you send emails or other communications to us, we may retain those communications to process your inquiries, respond to your requests, and improve our services. When you send and receive SMS messages to or from one of our services that provides SMS functionality, we may collect and maintain information associated with those messages, such as the phone number, the wireless carrier associated with the phone number, the content of the message, and the date and time of the transaction. We may use your email address or phone number to communicate with you about our services.

 

Third-Party Applications: Plates may make available third-party applications through its services. The information we collect when you enable a third-party application is processed under this Privacy Policy. Information collected by a third-party application provider is governed by their privacy policies.

Location data: We may offer location-enabled services. If you use those services, Plates may receive information about your actual location (such as GPS signals sent by a mobile device) or information that can approximate a location (such as a cell ID).

 

In addition to the above, we may use the information we collect to:

  • Protect the rights or property of Plates or our users;

  • Provide, maintain, protect, and improve our services and develop new services;

  • Send you promotional messages, marketing, advertising, and other information that may be of interest to you based on your preferences and social media advertising through social media platforms such as Facebook or Instagram);

  • Personalize, measure, and improve our advertising;

  • Administer referral programs, rewards, surveys, sweepstakes, contests, or other promotional activities or events sponsored or managed by Plates or its third-party partners; and

  • Conduct profiling on your characteristics and preferences (based on the information you provide to us, your interactions with the App, information obtained from third parties, and your search and Hosted Event history) to send you promotional messages, marketing, advertising, and other information that we think may be of interest to you.

 

We process personal information on our servers in the United States of America and in other countries. In some cases, we process personal information outside your country of residence.

Opt-out Choices

We will process your personal information for the purposes set forth herein given our legitimate interest in undertaking marketing activities to offer you products or services that may interest you. You can opt-out of receiving marketing communications from us by following the unsubscribe instructions included in our marketing communications or changing your notification settings within your End User account. If we use this information in a manner different than the purpose for which it was collected, then we will ask for your consent prior to such use.

Should you choose to opt-out of being contacted by Plates for any reason, you can change your notification settings within your End User account.

You may refuse cookies; however, some Plates features and services may not function properly if your cookies are disabled.

Children’s Privacy

We do not knowingly collect information from children under 13 years of age. The App and the Services are not intended for or in any way targeted to children under 13 years of age. End Users must be at least 18 years old. Any access to or use of the Service or the App by anyone under 18 is expressly prohibited. By using or accessing our Service and/or App, you represent and warrant that you are 18 years or older. If any parent, guardian, or other person becomes aware that a child under the age of 13 has submitted any information to Plates or Plates has otherwise posted or obtained any information about a child under the age of 13, please notify us by emailing us at info@Plates.io, and we will take appropriate steps to remove and/or delete the information.

California Privacy Rights

If you are a resident of California, in addition to the rights set forth in this Privacy Policy, you generally have the right to request information from us regarding the manner in which we share certain categories of personal information with third parties for their direct marketing purposes.

Information Sharing

We only share personal information with other companies or individuals outside of Plates in the following limited circumstances:

We have your consent. We require opt-in consent for the sharing of any sensitive personal information.

We provide such information to our subsidiaries, affiliated companies, or other trusted businesses or persons for the purpose of processing personal information on our behalf. We require that these parties agree to process such information based on our instructions and in compliance with this Privacy Policy and any other appropriate confidentiality and security measures.

We have a good faith belief that access, use, preservation, or disclosure of such information is reasonably necessary to (a) satisfy any applicable law, regulation, legal process, or enforceable governmental request, (b) enforce applicable Terms of Service, including investigation of potential violations thereof, (c) detect, prevent, or otherwise address fraud, security or technical issues, or (d) protect against harm to the rights, property or safety of Plates, its users or the public as required or permitted by law.

If we become involved in a merger, acquisition, or sale of some or all of our assets, your personal information may be transferred and subject to a different privacy policy. We will notify you if and when any such transaction is completed if we have a valid email address for you.

Information Security

We restrict access to personal information to our employees, contractors, and agents who need to know that information to process it on our behalf. These individuals are bound by confidentiality obligations and may be subject to discipline, including termination and criminal prosecution, if they fail to meet these obligations.

Changes to this Privacy Policy

Please note that this Privacy Policy may change from time to time. We will post any Privacy Policy changes on this page. Your continued use of the App and/or Services signifies your compliance with the then-current Privacy Policy on a going-forward basis.

Personal Information

Your End User Account. We ask for some personal information when you create an account, including your email address and a password, which is used to protect your account from unauthorized access.

Usage Information. When you use the App, we may record information about your usage of the App, such as other End Users that you engage in a Hosted Event with, Invitations you accept, which other End Users you communicate with, and information you display about yourself as well as information you click on in the App. If you are logged in, we may associate that information with your End User account.

Content Uploaded to Site. Any personal information or video content you voluntarily disclose via the App and/or the Services may be collected and used by others.

Use of Personal Information

If you submit personal information to us, we may use that information to operate, maintain, and improve the features and functionality of the App and Plates products and services, and to process any flagging activity or other communication you send to us.

We may use your email address or other personal information to send commercial or marketing messages without your consent. We may also use your email address without further consent for non-marketing or administrative purposes (such as notifying you of major Plates changes or customer service purposes).

We use cookies, web beacons, and log file information to: (a) store information so that you will not have to re-enter it during your visit or the next time you visit the App; (b) provide custom, personalized content, and information; (c) monitor the effectiveness of our marketing campaigns; (d) monitor aggregate metrics such as total number of visitors and pages viewed; and (e) track your entries, submissions, and status in promotions, sweepstakes, and contests.

Publicly Available information

When you create an End User account, some information about your End User account and your account activity will be provided to other End Users. This may include the date you opened your End User account, the date you last logged into your End User account, the content you have created, the number of followers you have or Hosted Events you’ve attended or hosted, the people you are following, and where you are from.

Your End User account name, not your email address, is displayed to other users when you engage in certain activities on the App. Other End Users can contact you by leaving a message or comment on the site.

Any content you submit to us (via the App, the Services, or otherwise) may be redistributed through the internet and other media channels and may be viewed by other End Users or the general public.

You may also add personal information, including your name, gender, profile picture, or other details, that will be visible to other users on your End User profile.

Your Choices

If you have an End User account, you may access, update, correct, or delete your personal profile information, email preferences, and privacy settings at any time by visiting your account profile page, provided that we may retain this information for legally permitted purposes. You may also exercise your rights, subject to applicable laws, to request that we restrict access to your personal data.

You may control the information available to other users at any time by editing your privacy settings.

You may decline to submit personal information through the App, in which case you can still explore the App and the Services, but we may not be able to provide certain services to you.

Users from Outside the United States

The App is hosted in the United States. The App is governed by applicable federal, state, and local laws. If you are visiting the App and accessing the Services from outside the United States, your information may be transferred to, stored, and processed in the United States. The data protection and other laws of the United States and other countries may not be as comprehensive as those in your country. Your information may be available to government authorities under lawful orders and laws applicable in such jurisdictions. By visiting the App, submitting information, or using any Services, you acknowledge that you accept the practices and policies outlined in this Privacy Policy and consent to having your data transferred to and processed in the United States. If you disagree with this Privacy Policy, please do not use the App or the Services.

By submitting any content or personal information to us, you acknowledge that you are submitting the information to the United States and it is collected and maintained in the United States.
